RIGHTS AND RESPONSIBILITIES

All procedures are explained to you clearly and in detail, including any instructions you may need before or after your exam. Education materials that describe our procedures and the possible medical conditions to be found durings these exams are available for your use.

In addition, the West Shore Endoscopy Center has prepared a concise statement of patient rights and responsibilities, which we believe are the basis of a positive, mutually beneficial patient-doctor relationship.

The West Shore Endoscopy Center is a federal and state licensed ambulatory surgical facility. It is regularly inspected and conforms to the guidelines of national accreditation organizations.

It is the policy of all of our doctors, nurses and other medical staff members to respect your individuality, dignity and privacy and to make your stay as pleasant as possible. As a patient at the West Shore Endoscopy Center, you have specific rights that protect your interest. You also have responsibilities to help us to provide you with efficient, quality care. Together, these rights and responsibilities provide the basis for a more positive, mutually beneficial patient-physician relationship.

PATIENT'S BILL OF RIGHTS

  1. A patient has the right to respectful care given by competent personnel.

  2. A patient has the right, upon request, to be given the name of his attending practitioner, the name of all other practitioners directly participating in his care and the names and functions of other health care persons having direct contact with the patient.

  3. A patient has the right to consideration of privacy concerning his own medical care program. Case discussion, consultation, examination and treatment are considered confidential and shall be conducted discreetly.

  4. A patient has the right to have records pertaining to his medical care treated as confidential except as otherwise provided by law or third party contractual agreements.

  5. A patient has the right to know what ambulatory surgery facility rules and regulations apply to his conduct as a patient.

  6. The patient has the right to expect emergency procedures to be implemented without unnecessary delay.

  7. The patient has the right to good quality care and high professional standards that are continually maintained and reviewed.

  8. The patient has the right to full information in layman's terms, concerning diagnosis, treatment and prognosis, including information about alternative treatments and possible complications. When it is not medically advisable to give information to the patient, the information shall be given on his behalf to the responsible person.

  9. Except for emergencies, the practitioner shall obtain the necessary informed consent prior to the start of a procedure.

  10. A patient or, if the patient is unable to give informed consent, a responsible person, has the right to be advised when a practitioner is considering the patient as part of medical care research program or donor program, and the patient, or responsible person, shall give informed consent prior to the actual participation in the program. A patient, or responsible person, may refuse to continue in a program to which he has previously given informed consent.

  11. A patient has the right to refuse drugs or procedures, to the extent permitted by statute, and a practitioner shall inform the patient of the medical consequences of the patient's refusal of drugs or procedures.

  12. A patient has the right to medical and nursing services without discrimination based upon age, race, color, religion, sex, national origin, handicap, disability or source of payment.

  13. The patient who does not speak English shall have access, where possible, to an interpreter.

  14. The ambulatory surgery facility shall provide the patient, or patient designee, upon request, access to the information contained in his medical records, unless access is specifically restricted by the attending practitioner for medical reasons.

  15. The patient has the right to expect good management techniques to be implemented within the ambulatory surgery facility. These techniques shall make effective use of the time of the patient and avoid the personal discomfort of the patient.

  16. When an emergency occurs and a patient is transferred to another facility, the responsible person shall be notified. The institution to which the patient is to be transferred shall be notified prior to the patient's transfer.

  17. The patient has the right to examine and receive a detailed explanation of his bill.

  18. A patient has the right to expect that the ambulatory surgery facility will provide information for continuing health care requirements following discharge and the means for meeting them.

  19. A patient has the right to be informed of his rights at the time of admission.

A patient has the right, without recrimination, to voice complaints regarding his/her care, to have those complaints reviewed, and when possible resolved.

PATIENT RESPONSIBILITIES

  1. While practicing at the West Shore Endoscopy Center, your doctor is obligated to exercise good medical judgment in order to help you. It is your responsibility to cooperate in the treatment program that your doctor specifies.

  2. It is your responsibility to ask questions immediately if you do not understand instructions concerning your health or if you feel you cannot follow the instructions.

  3. It is your responsibility to keep all scheduled appointments, or to contact WSEC when you cannot keep an appointment.

  4. It is your responsibility to bring with you information about past illnesses, hospitalizations, medications and other matters relating to your health.

  5. You are expected to show consideration for the privacy and comfort of other patients and medical personnel and to assist in the control of noise. You are also expected to be respectful of the property of other persons, and the property of the West Shore Endoscopy Center.

  6. Duly authorized members of your family are expected to be available to WSEC personnel for review of your treatment in the event you are unable to communicate with the physicians or nurses.

  7. Your care may involve sedation, analgesia or anesthesia. You have a responsibility to help us reduce your risk of injury due to falling by following the safety guidelines provided by our medical staff.

  8. You have a responsibility to provide information necessary for insurance processing of your bills, to be prompt about payment of West Shore Endoscopy Center bills and to ask any questions you may have concerning your bills.

If you are concerned about or displeased with any aspect of your care, we ask that you discuss the problem with the director of the West Shore Endoscopy Center. Communication between you and the West Shore Endoscopy Center team is an important element in good health care. Suggestions or comments you would like to make following discharge are most appreciated.
